Terms of Service

1.Eligibility & accounts

You must be at least 13 years old (or the minimum age required in your country) to use the Services. You are responsible for your account and for keeping your sign-in credentials secure. Provide accurate information and tell us promptly if you suspect unauthorized use of your account.

2.License to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and Services for your own non-commercial enjoyment. You may not copy, modify, reverse engineer, resell, or interfere with the Services, or use them in violation of any law.

3.Physical pins & digital collectibles

Physical pins you purchase are yours. Each PinTap-enabled pin carries a unique digital identity; claiming a pin links that identity to your account and unlocks associated digital content — artwork, achievements, experiences, and rewards ("Digital Items").

• Digital Items are licensed, not sold. They have no monetary value, are not redeemable for cash, and are not an investment.
• Digital Items are tied to your account and, where applicable, to the physical pin. We may provide mechanisms to transfer a claim when a pin changes hands; outside those mechanisms, claims are non-transferable.
• We may add, change, or retire Digital Items and experiences over time. Live experiences (events, limited activations) are inherently time-limited.

4.Purchases

In-app purchases are processed by Apple or Google under their terms, and their refund policies apply. Except where required by law, purchases are final. Physical pin purchases from third-party retailers are governed by that retailer's terms.

5.Acceptable use

• Don't clone, emulate, or tamper with NFC tags, pin identities, or scanning features, or claim pins you don't possess.
• Don't exploit bugs, automate the Services, or manipulate events, achievements, or promotions.
• Don't harass or harm other users, or post unlawful, infringing, or abusive content in any community feature.
• Don't use the Services to infringe anyone's intellectual property or privacy.

We may suspend or terminate accounts that violate these rules, including removing improperly obtained Digital Items, entries, or rewards.

6.Community features & your content

Where the Services let you post or share content (profiles, messages, community boards), you keep ownership of what you create, and you grant us a worldwide, royalty-free license to host and display it as part of operating the Services. You are responsible for what you post. We may remove content that violates these Terms.

7.Intellectual property

The Services — including software, artwork, trademarks, and Digital Item designs — are owned by us or our licensors and protected by intellectual property laws. Partner and licensor brands appearing on pins or in experiences belong to their respective owners.

8.Promotions & sweepstakes

Contests, giveaways, and sweepstakes offered through the Services (such as the Year of the Devil giveaway) are governed by their own official rules, which control over these Terms for that promotion. See pintap.xyz/yotd/rules for the Year of the Devil Official Rules.

9.Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise the Services will be uninterrupted, error-free, or that any particular experience, event, or Digital Item will remain available.

10.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THREADTAP, INC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow these limits, so they may not fully apply to you.

11.Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Services will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue there. To the fullest extent permitted by law, any dispute will be brought individually and not as part of a class, consolidated, or representative action.

12.Termination

You can stop using the Services or delete your account at any time (see pintap.xyz/account-deletion). We may suspend or terminate access for violations of these Terms or to protect the Services. Sections that by their nature should survive termination (IP, disclaimers, liability limits, disputes) survive.

13.Changes to these Terms

We may update these Terms as the Services evolve. For material changes we'll give you notice in the app or by email before they take effect; continuing to use the Services after that means you accept the updated Terms.
